CDC Issues New Eviction Moratorium Order

On Tuesday August 3, 2021 the CDC Director signed a new eviction moratorium order, temporarily halting residential evictions for nonpayment of rent in counties with substantial and high transmission (definitions on pg. 3 subsection 9) of COVID-19 transmission. The order is set to expire on October 3, 2021.

To be covered under the new order tenants must have made their best effort to obtain all governmental assistance for rent/housing and meet one of the following income requirements:

  • Cannot have earned more than $99,000 (or $198,000 filing jointly) in 2020 or expects to earn no more than this amount in 2021
  • Were not required to report any income in 2020 to the IRS
  • Received a 2020/2021 stimulus check (Economic Impact Payment)

Tenants need to provide the landlord a declaration under penalty of perjury to be secured under this order.
